PERSONAL DATA & INFORMATION REFERENCE FOR CUSTOMERS OF OSK HOLDINGS BERHAD, ITS SUBSIDIARIES AND ITS GROUP OF COMPANIES

DATA PERIBADI & INFORMASI RUJUKAN UNTUK PELANGGAN-PELANGGAN OSK HOLDINGS BERHAD, SUBSIDIARINYA DAN KUMPULAN SYARIKAT-SYARIKATNYA

1. COLLECTION OF PERSONAL INFORMATION

This Personal Data & Information Reference is issued to all our customers pursuant to the requirements of the Malaysian Personal Data Protection Act 2010.

In the course of your dealings with OSK Holdings Berhad and/or its Subsidiaries and/or its Group of Companies, we may request you to provide us information about yourself (“Personal Information”) to assist our communication with you or to deliver the necessary notices, services and/or products in connection with our business nature. These are inclusive of necessary business process, announcement of services and/or products, client relationship management needs, marketing communication for future products’ launches, and current product promotional and events activities.

PENGUMPULAN INFORMASI PERIBADI

Rujukan Data Peribadi & Informasi ini dihantar kepada semua pelanggan kami selaras dengan keperluan Akta Personal Data Protection 2010 Malaysia.

Sewaktu anda berurusan dengan OSK Holdings Berhad dan/atau Subsidiarinya dan/atau Kumpulan Syarikat-Syarikatnya, kami akan meminta anda untuk memberikan kami informasi berkenaan anda (“Informasi Peribadi”) untuk membantu kami berkomunikasi dengan anda atau untuk menyampaikan notis, perkhidmatan dan/atau produk berhubungan dengan sifat perniagaan kami. Ia adalah termasuk proses perniagaan, pengumuman perkhidmatan dan/atau produk, pengurusan keperluan perhubungan pelanggan, perhubungan pemasaran untuk pelancaran produk baru, dan promosi produk terkini dan acara-acara aktiviti.

2. NATURE OF PERSONAL INFORMATION

Such Personal Information may be subject to applicable data protection, privacy and other similar laws and may include information such as name, identity card number, passport number, address, gender and other information deemed necessary.

SIFAT INFORMASI PERIBADI

Informasi Peribadi tersebut mungkin tertakluk kepada undang-undang perlindungan data, privasi dan undang-undang serupa yang lain yang terpakai dan mungkin merangkumi informasi seperti nama, nombor kad pengenalan, nombor paspot, alamat, jantina dan informasi-informasi yang dianggap perlu.

3. OBJECTIVES OF COLLECTING PERSONAL INFORMATION

The Personal Information you have provided to us will be used or processed by us for, amongst others, the following purposes:

  1. customer relationship management needs;
  2. present or future delivery of various communication tools for our services or products, inclusive of marketing related services or products to you;
  3. enable us to send you information by way of e-mail, available telecommunication means (be it telephone calls, text messages, fax and others) or social media communication means about our products and services offered, by our appointed third parties. In view of this, we will maintain control and safety over your Personal Information at our best efforts;
  4. to perform related marketing and customer profiling activities as deemed necessary, in connection with our services and related products;
  5. our internal record keeping use;
  6. as a way of communication from us to you to perform necessary transaction, agreement and/or contract in relation to the products offered;

OBJEKTIF PENGUMPULAN INFORMASI PERIBADI

Informasi Peribadi yang diberikan oleh anda akan digunakan atau diproseskan oleh kami untuk, antara lain, tujuan-tujuan berikut:
  1. pengurusan keperluan perhubungan pelanggan atau pengguna;
  2. penyampaian pelbagai cara komunikasi pada masa kini atau di masa hadapan untuk perkhidmatan kami atau produk kami, termasuk pemasaran perkhidmatan atau produk kepada anda;
  3. membolehkan kami untuk menghantar informasi melalui e-mel, cara telekomunikasi yang sedia ada (sama ada panggilan telefon, pesanan teks, faks dan lain lain) atau komunikasi media sosial berkenaan produk dan perkhidmatan yang ditawarkan, oleh pihak ketiga yang dilantik oleh kami. Sehubungan itu, kami akan memastikan pengawalan dan keselamatan Informasi Peribadi anda sebaik mungkin;
  4. menjalankan aktiviti pemasaran dan pemprofilan pelanggan seperti yang diperlukan, berkaitan dengan perkhidmatan dan produk berkaitan;
  5. penyimpanan rekod dalaman kami;
  6. sebagai cara komunikasi daripada kami kepada anda untuk melakukan transaksi yang perlu, perjanjian dan/atau kontrak berkenaan produk yang ditawarkan;

4. DISCLOSURE

Your Personal Information provided to us will generally be kept confidential. You hereby consent and authorise us to provide or disclose your Personal Information to the following categories of parties, whenever deemed necessary without prior notice:
  1. any related companies and subsidiaries of OSK Holdings Berhad and/or its subsidiaries, at present or future establishment;
  2. our appointed business partners and third party service or product providers that provide related services or products in connection with our business;
  3. our auditors, consultants, accountants, lawyers or other financial or professional advisers, deemed necessary for their business nature;
  4. government agencies, statutory authorities and industry regulators.

PEMAKLUMAN

Informasi Peribadi yang diberikan kepada kami secara amnya akan dirahsiakan. Anda dengan ini membenarkan dan memberi kuasa kepada kami untuk memberikan atau mendedahkan Informasi Peribadi anda kepada pihak-pihak yang berikut, seperti mana dianggap perlu tanpa sebarang notis:
  1. mana-mana syarikat berkaitan atau anak syarikat kepada OSK Holdings Berhad dan/atau anak syarikatnya, pada masa kini atau yang akan ditubuhkan di masa hadapan;
  2. rakan kongsi perniagaan yang dilantik oleh kami dan pihak pemberi perkhidmatan atau produk pihak ketiga yang menyediakan perkhidmatan atau produk yang berkaitan berkenaan perniagaan kami;
  3. juruaudit, konsultant, akauntan, peguam kami atau mana-mana penasihat kewangan atau professional, yang dianggap perlu untuk keperluan perniagaan kami;
  4. agensi kerajaan, pihak berkuasa berkanun dan pengawal selia industry.

5. OUTCOMES RESULTING FROM INSUFFICIENT OR INCOMPLETE PERSONAL INFORMATION

The failure to supply such Personal Information:
  1. may result in us being unable to reach out to our customers with the notices, services and/or products, launches, marketing & promotional activities and events, inclusive of current and future announcement and activities, deemed necessary;
  2. may affect the ability of the parties involved to enter into the necessary transactions/arrangements.

KESAN AKIBAT DARIPADA INFORMASI PERIBADI YANG KEKURANGAN ATAU TIDAK LENGKAP

Kegagalan untuk membekalkan Informasi Peribadi:
  1. akan mengakibatkan kami tidak dapat menyampaikan kepada pelanggan-pelanggan kami dengan notis, perkhidmatan dan/atau produk, pelancaran, pemasaran dan aktiviti-aktiviti dan acara-acara promosi, termasuk aktiviti-aktiviti terkini dan pengumuman akan datang, yang dianggap perlu;
  2. akan menyebabkan kebolehan pihak-pihak yang terlibat untuk memasuki transaksi/penyusunan.

6. SAFETY MEASURES

We shall process your information with necessary safety measures, to the best of our abilities. We endeavour, where deemed necessary, to implement the appropriate administrative and safety measures, systems and procedures in accordance with the applicable laws and regulations to prevent the unauthorised or unlawful processing of your Personal Information and the accidental loss or destruction of, or damage to, your Personal Information.

LANGKAH-LANGKAH KESELAMATAN

Kami akan memproses informasi anda dengan langkah-langkah keselamatan, di dalam kebolehan kami yang sebaiknya. Kami berusaha, di mana dianggap perlu, untuk melaksanakan pentadbiran dan langkah-langkah keselamatan, sistem dan prosedur selaras dengan undang-undang dan peraturan-peraturan yang terpakai untuk menghalang pemprosesan Informasi Peribadi anda yang tidak dibenarkan atau tidak sah dan kehilangan atau kemusnahan, atau kerosakan, pada Informasi Peribadi anda.

7. TRANSFER AND SHARING OF INFORMATION

Whenever we deem necessary or appropriate for the purposes of information storage or processing or providing any service or product to you, we may transfer your Personal Information to appointed third party service or product providers within or outside the country in which we are established, under conditions of confidentiality and similar levels of safety measures, without notice.

PEMINDAHAN DAN PERKONGSIAN DATA

Sekiranya kami menganggap perlu atau sesuai untuk tujuan penyimpanan informasi atau pemprosesan atau penyediaan mana-mana perkhidmatan atau produk kepada anda, kami boleh memindahkan Informasi Peribadi anda kepada pihak ketiga pihak perkhidmatan atau penyedia perkhidmatan yang dilantik di dalam atau di luar negara di mana kami ditubuhkan, dalam keadaan kerahsiaan dan tahap pelindung keselamatan dan langkah-langkah keselamatan yang serupa, tanpa notis.

8. YOUR RIGHTS OF ACCESS AND AMENDMENT (BY WRITE IN REQUEST)

8.1 You have the right to request access to and amendment of your information held by us and in this respect, you may, by way of writing in to us, to perform the aforementioned request:
  1. to check if we hold or use your Personal Information and request access to such information;
  2. to request that we amend any of your Personal Information that is inaccurate, incomplete or out-of-date;
  3. to inform us in future of your objection to the use of your Personal Information for marketing purposes whereupon we will not use your Personal Information for these purposes (after the notice);
  4. request to withdraw, in full or in part, your consent given previously to us, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period.

HAK AKSES DAN HAK PEMBETULAN ANDA (MELALUI PERMINTAAN BERTULIS)

8.1 Kamu mempunyai hak untuk meminta akses kepada dan pembetulan informasi anda yang disimpan oleh kami, dan dalam hal ini, anda boleh, melalui permintaan bertulis kepada kami, untuk melakukan permintaan di atas:
  1. untuk menyemak jika kami menyimpan atau menggunakan Informasi Peribadi anda dan meminta akses kepada informasi tersebut;
  2. untuk meminta kami membetulkan sebarang Informasi Peribadi anda yang tidak tepat, tidak lengkap atau ketinggalan zaman;
  3. untuk memaklumkan kepada kami di masa hadapan berkenaan bantahan anda untuk menggunakan Informasi Peribadi anda untuk tujuan pemasaran, di mana kami tidak akan menggunakan Informasi Peribadi anda untuk tujuan tersebut (selepas notis);
  4. meminta untuk menarik balik, dengan sepenuhnya atau sebahagiannya, kebenaran yang diberikan oleh anda sebelum ini kepada kami, dalam setiap keadaan tertakluk kepada sebarang sekatan undang-undang yang terpakai, syarat-syarat kontrak, dan tempoh masa yang munasabah.
